Waiver of disqualification
Disqualification is not always permanent or absolute. Both the Charity Commission and OSCR can waive it.
OSCR may waive a disqualification generally or in relation to a particular charity or type of charity, but must not do so where waiver would prejudice the operation of director disqualification legislation. The Commission has an equivalent power.
Apply before acting, not after — acting while disqualified is an offence regardless of whether a waiver would have been granted. See disqualification.
