Disposal of charity land

Charity land is protected by statute. The requirements are not advisory: they go to the validity of the disposition.

Before disposing of land, trustees must obtain and consider a written report from a designated adviser, and prescribed statements must appear in the disposition document. The Charities Act 2022 changed who may give that advice and simplified the required wording.

The requirement to take advice is imposed by statute, not by us — it is a condition of a valid disposal, not a recommendation. See disposing of charity land.
